Fitzgerald proposes changes to firearm definition for law enforcement technology

Congressman Scott Fitzgerald has introduced the Law-Enforcement Innovate to De-Escalate Act of 2025. The proposed legislation aims to provide law enforcement agencies with access to advanced less-lethal technology by amending the Gun Control Act of 1968 (GCA). This amendment would exclude "less-than-lethal projectile devices" from being classified as firearms.

Currently, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) categorizes new models of less-than-lethal equipment like TASER devices as firearms due to their propulsion method. This classification poses challenges for law enforcement in acquiring these tools essential for self-defense and de-escalation efforts. Additionally, it affects how police use of force is categorized since most states consider any firearm use as "deadly force."

"Law enforcement relies on less-than-lethal weapons to protect themselves in dangerous situations," stated Congressman Scott Fitzgerald. He emphasized the need for laws to evolve alongside technological advancements so that departments nationwide can obtain necessary equipment for public safety. "I’m proud to sponsor this bipartisan legislation," he added.

The bill has garnered support from several organizations including the Major County Sheriffs Association (MCSA), Major City Chiefs Association (MCCA), and International Union of Police Associations (IUPA).
