Waukesha County and several other counties in Wisconsin are being reclassified from "moderate" to "serious" nonattainment for ozone by the U.S. Environmental Protection Agency (EPA). This change will take effect on January 16, 2025. As a result, the Wisconsin Department of Natural Resources (DNR) will need to enforce stricter controls on nitrogen oxides (NOX) and volatile organic compounds (VOCs), which are pollutants that contribute to ozone formation.
This reclassification will impact businesses by lowering the threshold for what is considered a "major source" of air pollution. Consequently, more businesses will be required to obtain permits and comply with stricter emission limits. It is noted that much of the ozone in Wisconsin originates from out-of-state emissions, particularly from Chicago and Northern Indiana.
The new measures are expected to increase business costs in southeast Wisconsin while having limited effectiveness in helping the affected counties meet federal air quality standards. For further information on permitting requirements, businesses can consult with the DNR.
