On December 10, 2024, Fitzgerald expressed his gratitude for receiving the Defender of Limited Government award from the Institute for Legislative Analysis. He emphasized his commitment to protecting constitutional freedoms and curbing government overreach. "I am honored to received the Defender of Limited Government award again this year from the Institute for Legislative Analysis. I remain committed to protecting our constitutional freedoms and curbing government overreach!"

Two days later, on December 12, 2024, he announced his support for the Fiscal Year 2025 National Defense Authorization Act (NDAA). He highlighted that the act reflects Congress's commitment to military personnel and their families by providing a significant pay raise and improvements in housing, childcare, and healthcare services. "Proud to support FY25 NDAA - it reflects Congress's commitment to our troops & families: a 14.5% pay raise for junior enlisted troops, better housing, expanded childcare, & improved healthcare."

Later that same day, Fitzgerald addressed a report from the Department of Justice Office of Inspector General regarding violations of constitutional rights through abusive Non-Disclosure Orders (NDOs). He called for Senate action on his bipartisan NDO Fairness Act aimed at restoring accountability and implementing necessary guardrails. "The DOJ OIG report reveals a troubling violation of constitutional rights & disruption of Congress's oversight role through abusive NDOs."
