Fitzgerald proposes changes to firearm definitions for less-lethal police technology

Congressman Scott Fitzgerald has introduced the Law-Enforcement Innovate to De-Escalate Act of 2025. The legislation aims to provide law enforcement agencies with access to advanced less-lethal technology by amending the Gun Control Act of 1968 (GCA). This amendment would exclude "less-than-lethal projectile devices" from being classified as firearms.

Currently, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) categorizes new models of less-than-lethal equipment like TASER devices as firearms. This classification is based on how these devices propel objects, despite their low risk of causing serious injury or death. As a result, obtaining these devices for self-defense and de-escalation purposes has been challenging for law enforcement agencies. Furthermore, this classification affects how police use of force is recorded since using any firearm is considered "deadly force" in most states.

"Law enforcement relies on less-than-lethal weapons to protect themselves in dangerous situations," stated Congressman Scott Fitzgerald. "Technology has progressed quickly and it’s important the law evolves to ensure departments across the country can access the critical equipment they need to keep us safe. I’m proud to sponsor this bipartisan legislation."

The bill has garnered support from several organizations including the Major County Sheriffs Association (MCSA), Major City Chiefs Association (MCCA), and International Union of Police Associations (IUPA).
