Fitzgerald on border crisis: 'The damage is already done'

Wisconsin State Representative Scott Fitzgerald criticized President Biden's claim of having "run out of options" to address the border crisis, following an executive order aimed at "controlling the flow." Fitzgerald argued that the order is "riddled with exceptions" and does "nothing" to resolve the crisis that has persisted for over three years. He made his statement in a June 5 post on X.

"Biden told us for months he's 'run out of options' to fix the border crisis," said U.S. Rep. Scott Fitzgerald (R-Wi). "Now he's issued ONE singular exec order to 'control the flow' but don't be fooled, it's riddled with exceptions. The damage is already done. This does NOTHING to fix his crisis 3+ yrs in the making."

According to a press release by Whitehouse.gov, the Biden Administration's Proclamation on Securing the Border outlines Section 1187 of Title 8, United States Code. This section states the conditions under which noncitizens can enter the United States, specifically addressing those arriving at southwest land border ports of entry. Entry decisions are influenced by factors such as significant law enforcement concerns, considerations for officer and public safety, urgent humanitarian needs, and public health interests at the time of entry. Additionally, Customs and Border Protection (CBP) immigration officers assess operational considerations during encounters to determine whether entry is warranted.

Fitzgerald made his comments in response to an X post by House Homeland GOP stating: "The exceptions to Biden's new EO are broad enough to drive a truck through. They include 'any noncitizen who is permitted to enter...based on the totality of the circumstances...'. Look at that list of 'circumstances.' They are the same reasons as for CBP One, CHNV, etc."

Fitzgerald serves Wisconsin’s Fifth Congressional District in the U.S. House of Representatives. He succeeded his tenure in the Wisconsin State Senate from 1995 to 2021, where he held leadership roles such as Majority Leader and Minority Leader. According to House.gov, Fitzgerald has a military background, having served in the US Army Reserve for 27 years and attaining the rank of Lieutenant Colonel before retiring.
